Rivers: Court Throws Out Fubara’s Case Against Amaewhule and 26 Lawmakers
A big political case in Rivers State has just been thrown out by the court!
The Federal High Court sitting in Port Harcourt has dismissed a case brought by the Rivers State Government, led by Governor Siminalayi Fubara, along with Victor Oko-Jumbo and two others. They were challenging Martin Amaewhule, the suspended Speaker of the Rivers State House of Assembly, and 26 other lawmakers.
So what was the fight about?
Governor Fubara and his team claimed that Amaewhule and the other 26 lawmakers had left the PDP (Peoples Democratic Party) and secretly joined the APC (All Progressives Congress). Because of this, they believed the lawmakers no longer had the right to stay in the House of Assembly or make any decisions on behalf of the people.
But when the case came to court, something unexpected happened.
Fubara’s lawyer asked the judge to postpone the hearing. However, the other side—the lawyers for Amaewhule and his group refused, saying the court should go ahead and give a judgment.
Justice Emmanuel Obile, the judge in charge of the case, agreed with Amaewhule’s lawyers.
Then came the bombshell: the judge dismissed the case.
Why? Justice Obile said that the Supreme Court Nigeria’s highest court had already ruled on a similar issue before. So he had no power to reopen or judge the same matter again.
In simple terms, the judge said, “This matter don already settle for Supreme Court. I no fit talk am again.”
This is actually the second time the same judge has thrown out a case like this. Not long ago, he also dismissed a case from the Labour Party against the same lawmakers, for the exact same reason no jurisdiction.
Summary:
Governor Fubara and others took 27 lawmakers to court for allegedly leaving PDP for APC.
The judge said he had no right to handle the case because the Supreme Court has already decided on it.
So, the case was dismissed meaning it’s over.
What does this mean for Riverspeople?
For now, Martin Amaewhule and the 26 lawmakers remain in their positions, and the political drama continues in Rivers State.
